This policy is part of the Terms of Service and applies to every user, team member, script, AI agent and Creator acting under an account. It also contains the information required by the EU Digital Services Act. "We" means TeraShift GmbH, Hauptstrasse 35a, 8272 Ermatingen, Switzerland.
1. Your responsibility
You are responsible for everything done with your account, your keys and the Services, and for ensuring your use is lawful. Using Scrape.ly does not make any use lawful. You must comply with the law that applies to you, to us and to the sites, services and people your use affects, including the terms of the sites your runs access, and must not place an unreasonable load on them. Our proxies, browsers and unblocking features help your runs reach publicly available content; you must not use them to reach content or accounts that are not publicly available without authorisation.
2. Logins and non-public content
You may log in to a site only with an account you own or are authorised to use, and only within that authorisation. You must not access accounts, systems or data you are not authorised to access; get around paywalls, authentication or other access controls on non-public content; use stolen credentials, cookies, tokens or payment data; or carry out credential stuffing, account takeover, brute-force or password-spraying attacks.
3. Personal data and people data
If you process personal data, you are the controller of it and the processor terms in the Privacy Policy apply. You must have a valid legal basis, collect only what you need, give the required notices, honour data subject rights and meet your other obligations as controller, including for special categories of data. If you run Actors that find information about people, you must have a lawful purpose for each run and must not use the results to decide eligibility for credit, insurance, employment, housing or benefits (or for any other purpose that makes them a consumer report under the US Fair Credit Reporting Act or similar law), to stalk, harass, intimidate, dox or locate anyone against their will, for illegal surveillance, to discriminate, or for unsolicited marketing.
4. Prohibited uses
You must not use the Services to:
- break any law, or infringe anyone's rights, including copyright, database, trademark and trade-secret rights;
- create, store or distribute child sexual abuse material, terrorist content or other illegal content;
- commit or support fraud, phishing, scams, identity theft or money laundering;
- send spam or unsolicited bulk messages, or create fake accounts, engagement, reviews or traffic;
- run malware, ransomware, spyware, backdoors or keyloggers, or any code designed to damage or gain unauthorised access to a system;
- carry out denial-of-service attacks, or scan or test systems you are not authorised to test;
- mine cryptocurrency, or use our resources for purposes unrelated to the Actors you run;
- engage in a practice prohibited by Article 5 of the EU AI Act (Regulation (EU) 2024/1689), such as manipulative or exploitative techniques, social scoring, or building facial-recognition databases by untargeted scraping of facial images;
- breach sanctions or export control law;
- probe, scan, attack or overload our infrastructure, escape the run environment, or access other users' data, runs or accounts;
- avoid or manipulate billing, usage limits, spending caps or rate limits, including by misusing an Actor's charging mechanism;
- hold more than one free account per person or organisation, or use fake identities or other methods to obtain free or promotional credit;
- resell, sublicense or provide access to the Services as a service to third parties, except by running Actors to deliver your own products and services, or with our written consent;
- manipulate Store rankings, ratings, reviews, usage statistics or bookmarks, or post false reviews or issues;
- impersonate anyone, or misrepresent your affiliation; or
- help or encourage anyone else to do any of these things.
5. Enforcement
If we reasonably believe that you, your content or your use breaches this policy, the Terms or the law, or puts anyone or our infrastructure at risk, we may, without liability to you: stop runs, block requests or limit features or resources; remove or restrict content, Actors, datasets or listings; revoke free or promotional credit; suspend or terminate your account; forward complaints to you and share necessary information with the complainant where the law permits; and report the matter to authorities and cooperate with them. You remain liable for any breach, including under the indemnity in the Terms. Where a measure is based on content we consider illegal or a breach of the Terms, we give a statement of reasons and explain how to ask for a review, as in section 6.
6. Digital Services Act
We host content you provide — Actors, listings, profiles, reviews, issues, datasets and results — and make some of it public in the Store, so we are a hosting service under Regulation (EU) 2022/2065. Our point of contact for the authorities of EU Member States, the Commission and the Board for Digital Services, and for users, is dsa@scrape.ly; we also answer on +41 91 239 14 85 and in English and German. Our legal representative in the EU under Article 13 DSA is our EU representative in section 23 of the Terms of Service, addressable instead of us on all DSA matters.
Reporting illegal content. Anyone may report content they consider illegal, including copyright and trademark infringements, to abuse@scrape.ly. Give a substantiated explanation of why the content is illegal, its exact location (URL, Actor name or ID, review or issue), your name and email, and a statement that you believe your notice is accurate. We confirm receipt without undue delay, decide in a timely, diligent, objective and non-arbitrary manner, may use automated tools, and tell you the outcome and how to ask for review. If your content was removed because of someone else's notice, you may explain why it is lawful.
Our decisions. Moderation combines automated publication checks with review by our staff of notices, complaints and flagged content. If we remove or restrict your content or monetization, or suspend or terminate your account, we send a statement of reasons at the latest when the measure takes effect: the measure, the facts, whether automated means were used, the ground, and how to seek redress. We may skip it where we lack your details, for high-volume commercial content, or where an authority ordered otherwise. Ask for review at dsa@scrape.ly within 6 months; a person decides, and we reverse a wrong decision.
Other duties. We may suspend, after a prior warning, users who frequently provide manifestly illegal content, and the processing of notices from those who frequently submit manifestly unfounded ones. We tell the authorities of the effect given to their orders and inform the affected user where the law allows, and we promptly inform law enforcement of a suspected criminal offence threatening life or safety.
7. Reporting and contact
Report misuse or content you consider illegal to abuse@scrape.ly or through the live chat. Report a security vulnerability to security@scrape.ly. We may update this policy as set out in the Terms. TeraShift GmbH, Hauptstrasse 35a, 8272 Ermatingen, Switzerland.
